§ 8-168. Records and reports.

  • (a)

    Each grantee shall file annually the following records and reports with the county not later than three (3) months after the end of its fiscal year:

    (1)

    The report to its stockholders, if any.

    (2)

    An annual financial report in a form approved by the chief executive containing balance sheet, statement of income, statement of changes in retained earnings, statement of changes in ownership equity, notes to financial statements and supplementary schedules reconciled to the foregoing identifying revenues, expenses and income applicable to the operation of its CATV system. Such statements shall be prepared in accordance with generally accepted accounting principles applied on a consistent basis and shall be audited by an independent certified public accountant.

    (3)

    A schedule of property used in its CATV system showing book value on the basis of original cost, less depreciation, with such supporting information as the chief executive may require.

    (4)

    A facilities report setting forth the total physical miles of cable installed and the facilities currently in operation.

    (5)

    A copy of proof of performance tests required under FCC regulations and standards.

    (6)

    If a corporation is not publicly held, as defined by the rules and regulations of the United States Securities and Exchange Commission, a list of all current shareholders and bondholders both of record or beneficial. If a corporation is publicly held, as so defined, a list of all shareholders who individually or as a concerted group hold five (5) percent or more of the voting stock of the corporation.

    (7)

    A current list of all its officers and directors, including addresses and telephone numbers.

    (8)

    A list of all pertinent agreements or contracts, including pole use agreements, entered into by the grantee during the fiscal year in the conduct of its business under a franchise granted hereunder; actual copies of contracts shall be supplied upon request.

    (9)

    The names and both business and residential addresses and phone numbers of the franchisee's resident manager, engineer and/or consultant.

    (10)

    Copies of all rules and regulations promulgated by the grantee during the fiscal year in the conduct of its business.

    (b)

    The grantee shall file quarterly with the county, within forty-five (45) days of the end of each quarter, the following:

    (1)

    Quarterly financial statements containing the same information required for annual financial statements under paragraph (a)(2) above which shall be prepared in accordance with generally accepted accounting principles applied on a consistent basis and shall be accompanied by a certificate of the grantee's chief financial officer attesting to their completeness and accuracy.

    (2)

    A list of all complaints and CATV system down time received or experienced during the quarter. Such list shall also include complaint disposition and response time. For the purpose of this paragraph, certified copies of a complaint logbook reflecting all such incidents will suffice. The county shall have the right to review this complaint book at any time during the period.

    (c)

    All such reports and records shall be available for inspection by the public at the county courthouse, and such other locations as the board of commissioners may designate.

    (d)

    Each grantee shall simultaneously file with the chief executive a copy of each petition, application and communication transmitted by the grantee to, or received by the grantee from, any federal, state, local or other regulatory commissions or agencies having regulatory jurisdiction over any matters affecting cable television.
