§ 8-106. Initial service area.

(a)

Each franchise ordinance shall designate the part of the franchise area (the initial service area) where CATV service shall be available to all subscribers within the times specified below after the date of the adoption of the franchise ordinance, as follows:

(1)

Within one (1) year to at least twenty (20) percent of the dwelling units within the initial service area.

(2)

Within two (2) years to at least fifty (50) percent of the dwelling units within the initial service area.

(3)

Within three (3) years to all dwelling units within the initial service area.

(b)

If the connection from a trunk or feeder cable to any dwelling unit would require more than a standard one-hundred-fifty-foot aerial drop line, or its underground equivalent, the grantee may charge the subscriber the actual cost of the connection for the distance exceeding one hundred fifty (150) feet.
