§ 2-135. When sales conducted; terms of sale.
All personal property in the custody of the DeKalb County Police Department, including personal property used as evidence in a criminal trial, which is unclaimed after a period of ninety (90) days following its seizure, or following the final verdict and judgment in the case of personal property used as evidence, and which is no longer needed in a criminal investigation or for evidentiary purposes in accordance with O.C.G.A. § 17-5-55 or § 17-5-56, shall be subject to disposition by the police department. When articles of personal property in the possession of the DeKalb County Police Department have been authorized for sale by entry of an order of the DeKalb County Superior Court, as required by state law, the county will hold a public sale of all court-awarded, unclaimed articles of personal property. All articles will be sold to the highest bidder on an "as-is" basis, and the county makes no warranties of any nature, either expressed or implied, as to merchantable title, quality or performance.
