§ 7.4.12. Transfer of special land use permits.

  • A special land use permit, including the site plan and any conditions imposed at the time of the grant of the special land use permit by the board of commissioners, is granted to the person, corporation or other legal entity that applied for the permit. A special land use permit expires automatically upon change in ownership of the subject property, unless the special land use permit is transferred as authorized in this paragraph. A special land use permit may only be transferred from one (1) person, corporation, or other legal entity to another person, corporation, or other legal entity upon application to the director of planning. Any such application by any person, corporation, or other legal entity to transfer a special land use permit shall be accompanied by an affidavit of the proposed transferee certifying that the new owner or operator is familiar with and will abide by the approved site plan and all of the conditions, if any, imposed by the board of commissioners at the time of the grant of the special land use permit. At the time a special land use permit transfer is requested, the district and superdistrict commissioner shall be notified by the director of planning.
