§ 16-47. Smoking on public transportation.

  • (a)

    It shall be unlawful for occupants on Metropolitan Atlanta Rapid Transit Authority (MARTA) buses and railcars to smoke tobacco while the buses and railcars are transporting passengers within the unincorporated limits of the county.

    (b)

    For the purposes of this section, the word "occupants" shall mean any driver or passenger riding in and upon a bus or railcar operated by the Metropolitan Atlanta Rapid Transit Authority.

    (c)

    Violators of this section shall be subject to a fine which shall not be less than five dollars ($5.00) nor more than twenty-five dollars ($25.00).
