§ 1141. Penalties for transferring lots in unapproved subdivisions.

  • The owner or agent of the owner of any land to be subdivided within the county or municipality who transfers or sells or agrees to sell or negotiates to sell such land by reference to or exhibition of or by other use of a plat of subdivision of such land before such final plat has been accepted by the county or municipality and recorded in the office of the clerk of the superior court of DeKalb County, shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished as provided by law; and the description by metes and bounds in the instrument of transfer or other document used in the process of selling or transfer shall not exempt the transaction from such penalties. The county or municipality, through its attorney or other official designated by the governing authority of the county or the governing authority of the municipality may enjoin such transfer or sale or agreement by appropriate action.
