§ 38. Filling of vacancies in the office of sheriff.

  • When a vacancy in the office of sheriff of DeKalb County occurs, the chief deputy shall discharge the duties of sheriff until the vacancy is filled at the next special election; provided, however, that if it is not more than six months between the time such election can be called by the judge of the probate court and held and the expiration of the existing term, the chief deputy shall discharge the duties of the office for the balance of the term and there shall be no special election.
